In 2023, Swiss government measures rendered Credit Suisse's Additional Tier 1 (AT1) bonds worthless. Investors in various countries who suffered losses have already got into legal actions to recover them. In Japan, a class action lawsuit has been posed against securities firms which sold AT1 bonds. Beyond litigation, when losses occur because of overseas investments, investors may be able to utilize investment arbitration based on investment treaties between nations.
This seminar will explain the mechanisms and applications of investment arbitration and litigation funds (Third Party Funding) that advance procedural costs through contingency fee arrangements—recently started to gain traction in Japan—with the example of loss recovery efforts through AT1 bonds.
